Practice Areas

Unemployment Insurance

Ben is one of relatively few lawyers in New York State dedicated to representing workers in unemployment hearings and appeals.  If you've lost your job, and you've either been denied benefits or told to repay benefits already received, contact us today to learn about your rights.  The initial consultation is free.

Employment Discrimination

You have a right to a workplace free of discrimination on the basis of race, sex, age, disability, religion, sexual orientation, and a host of other protected categories.  Ben can help you understand how the law applies to your situation and can fight for your rights.  You deserve better.  Call us today.

Workers' Compensation

Ben serves as an independent "of counsel" to the Syracuse workers' compensation firm of Abdo & O'Brien, P.C.  With his colleagues at Abdo & O'Brien, Ben has successfully fought the insurance companies and won benefits for injured workers.  If you've been hurt at work, call Abdo & O'Brien today.

Labor Law

Generally, you have the right to form, join, and participate in the activities of a labor union.  If your employer interferes with these rights, you may have remedies.  Ben supports the labor movement and strongly believes unions are one of the best ways to improve the dignity of the workplace.  We can in some cases provide free advice to groups of workers seeking to form a new union.  We do not engage in litigation adverse to unions.

Wage & Hour

You work hard for your paycheck.  Your employer has a legal duty to pay you what you're owed—no excuses.  If you've been paid less than you were promised or not at all; if you've worked more than 40 hours in a week without 1.5x overtime pay; or if you otherwise aren't getting your due, let us know.

Severance Agreement Review

If you're being asked to sign a severance agreement, you need to know what it means.  Most severance agreements include a waiver of claims, and many include restrictive nondisclosure or noncompete clauses.  Burdick Law PLLC can help you understand your rights and evaluate potential claims so you know if you're getting a fair deal.
